'Following my October letter to the Chief of the Los Angeles Fire Department, I received a letter from Fire Marshal Jimmy Hill, telling me that he had directed an inspection of the RPF and referring me to Captain Michael White, Commander of the Schools, Churches and Institutions Unit, for further communication. I have been in contact with Captain White via phone and letters since October. [...]

Per my discussion with Captain White this morning, they found MANY violations of both fire codes and building & safety codes. Citations have been issued and requirements given for correction of these violations. The corrections will require time and, in Cpt. White's
opinion, quite a lot of expense. Big Blue is being given the necessary time, at the end of which inspections will be made to confirm that living and working conditions have been brought up to standard.[...]

If RPF Insider or someone else with contacts inside the LA RPF can update us on the response inside to these fire & building inspections, that would be much appreciated.'"

28 du Pacte international relatif aux droits civils et politiques,

Adopte ce qui suit:

DÉCISION CONCERNANT LA RECEVABILITÉ


1. Les auteurs de la communication sont Paul Arenz (premier auteur)
ainsi que Thomas Röder (deuxième auteur) et sa femme Dagmar Röder
(troisième auteur), tous trois de nationalité allemande et membres de
l'«Église de scientologie». Ils affirment être victimes de violations
par l'Allemagne (1) des articles 2, 18, 19, 22, 25, 26 et 27 du Pacte
international relatif aux droits civils et politiques. Ils sont
représentés par un conseil. M. Arenz est décédé en février 2004.

Rappel des faits présentés par les auteurs
2.1 Le 17 décembre 1991, au cours de son Congrès national, l'Union
démocrate chrétienne (CDU), un des principaux partis politiques en
Allemagne, a adopté la résolution C 47 par laquelle elle a déclaré que
l'appartenance à l'Église de scientologie n'était pas «compatible avec
le statut de membre de la CDU». Cette résolution est encore en
vigueur.


2.2 Dans une lettre datée du 22 septembre 1994, le Président de la
section municipale de la CDU à Mechernich (Rhénanie du
Nord-Westphalie), appuyé ultérieurement par le Ministre fédéral du
travail et le Directeur régional de la CDU en Rhénanie du
Nord-Westphalie, a demandé au premier auteur, membre de longue date de
ce parti, après avoir appris son affiliation à l'Église de
scientologie, de quitter la CDU avec effet immédiat en signant une
déclaration de démission. Ce dernier ayant refusé, le Conseil de la
CDU pour le district d'Euskirchen a décidé, le 17 octobre 1994,
d'entamer une procédure d'exclusion à son encontre, le dépouillant
ainsi de ses droits en tant que membre du parti en attendant que soit
prise la décision finale des organes d'arbitrage du parti.

8.4 Le Comité note que les héritiers de M. Arenz ont réaffirmé qu'ils
souhaitaient obtenir la réhabilitation et une satisfaction juste pour
le premier auteur défunt autant que pour eux-mêmes et conclut qu'ils
ont qualité, au titre de l'article premier du Protocole facultatif,
pour maintenir la communication au nom du premier auteur.


8.5 Pour ce qui est de l'argument de l'État partie, selon lequel il ne
saurait être tenu responsable de l'exclusion des auteurs de la CDU,
dès lors que la décision a été prise non pas par un de ses organes
mais par un organisme privé, le Comité rappelle qu'en vertu du
paragraphe 1 de l'article 2 du Pacte, les États parties sont tenus non
seulement de respecter mais de garantir à tous les individus se
trouvant sur leur territoire et relevant de leur compétence tous les
droits reconnus dans le Pacte, sans distinction aucune, notamment de
race, de couleur, de sexe, de langue, de religion, d'opinion politique
ou de toute autre opinion, d'origine nationale ou sociale, de fortune,
de naissance ou de toute autre situation. Si, comme dans l'affaire à
l'examen, une loi régit les partis politiques, ses dispositions
doivent être appliquées sans réserve. Les États parties sont donc en
outre tenus de protéger la pratique de toutes les religions ou
croyances contre toute atteinte (11) et de faire en sorte que, dans le
cadre de leur gestion interne, les partis politiques respectent les
dispositions applicables de l'article 25 du Pacte. (12)


8.6 Le Comité relève que, bien que les auteurs aient évoqué en passant
les difficultés que leur a values d'une façon générale leur
appartenance à l'Église de scientologie et l'obligation qu'a l'État
partie de garantir l'exercice des droits consacrés dans le Pacte, leur
plainte concrète porte uniquement sur leur exclusion de la CDU, grief
pour lequel ils ont épuisé les recours internes disponibles, au sens
du paragraphe 2 b) de l'article 5 du Protocole facultatif. Le Comité
n'a donc pas à examiner la question plus large des mesures d'ordre
législatif ou administratif qu'un État partie doit prendre pour
permettre à tous ses citoyens d'exercer effectivement le droit de
participer à la vie politique prévu à l'article 25 du Pacte. Le Comité
doit déterminer si l'État partie a commis une violation des droits des
auteurs tels qu'ils sont garantis par le Pacte du fait de la priorité
accordée par ses tribunaux au principe de l'autonomie des partis par
rapport au souhait des auteurs d'être membres d'un parti politique qui
ne les accepte pas en raison de leur appartenance à une autre
organisation idéologique. Le Comité rappelle sa jurisprudence
constante et réaffirme qu'il n'est pas une quatrième instance
compétente pour réexaminer les conclusions de fait ou l'application de
la législation nationale, sauf s'il peut être établi que les
procédures suivies par les juridictions nationales ont été arbitraires
ou ont représenté un déni de justice. Le Comité considère que les
auteurs n'ont pas montré, aux fins de la recevabilité, que la façon
dont les tribunaux de l'État partie ont statué était entachée
d'arbitraire ou représentait un déni de justice. La communication est
donc irrecevable en vertu de l'article 2 du Protocole facultatif.

9. En conséquence, le Comité des droits de l'homme décide:

a) Que la communication est irrecevable en vertu de l'article 2 du
Protocole facultatif;
b) Que la présente décision sera communiquée à l'État partie et aux
auteurs.

Note: nombre de journaux et télévisions français ont relaté les "efforts" scientologues... et les ont critiqués. Exemple passé sur le newsgroup fr.soc.sectes:

On vient d'apercevoir SIX scientologues sur Canal Plus... débarqués faisant
des "touch assists" à quelques victimes du Tsunami - la journaliste a
qualifié ces procédés bidon de "légers massages", reprenant probablement les
mots scientologues.

Intéressant, cette secte criminelle richissime a réussi à expédier moins
d'un millionième de ses membres sur place.

La sciento, d'après elle, coimpterait 8 à 20 millions de membres (cela
dépend du menteur scientologue qui vous le dit). Qu'elle envoie 6 personnes
vétues de leurs habits de faux-pompiers New-yorkais marqué "Ministre
Volontaire" avec la fausse croix scientologue, c'est peu.

Il eut été plus significatif que ces "charitables individus" envoient je ne
sais pas, une somme équivalente à l'argent gaspillé à tenterv de faire taire
ses critiques depuis 54 ans, soit plus de 300 millions de dollars... ou une
somme équivalente à mettons, 10 % du cadeau monstrueux que leur a fait le
fisc américain, évalué par l'empaqueté qui dirige la secte à UN MILLIARD de
dollars en 1993.

"BANDA ACEH, Indonesia - Even as Muslims in Indonesia's stricken Aceh province blame last month's tsunami on divine wrath, religious groups have rushed to join the huge aid operation, with Islam now joined by Christianity, Buddhism and even Scientology in the fight to save souls. [...]

The US-based Church of Scientology has also made its presence known in Banda Aceh, opening a 'trauma center' in three military tents where a score of Australian volunteers gently massage the fingertips of tsunami survivors. 'Think tsunami as a natural disaster, not a punishment from
God' A similar approach was used in India where Buddhist monks trained by the Scientologists in a technique called 'assist' used massage and conversation to keep people from focusing on their trauma. 'Nerve assist can restore communication between the 'Tethan' [sic] (Scientology's word for the spirit) and the body,' according to Scientology literature.

Dozens of Muslim and Christian groups are exploiting the chaos wrought by the tsunami in the Indonesian province of Aceh to spread their message and compete for influence, secular aid workers said yesterday. [...]

Downstairs four foreigners in Church of Scientology T-shirts, said to be Americans, were offering massage to refugees lounging on rattan mats. The church has set up an office in Banda Aceh. The Scientologists are unlikely to make many inroads among the devoutly Muslim population, but they could easily provoke clashes and a subsequent crackdown on humanitarian groups, international aid organisations fear. "You take traumatised people and do counselling for them, this is very dangerous," said one aid worker who has been in Aceh for years. [...]"

"SANTA CLARITA -- The city has declined a request from a group linked to the Church of Scientology that is seeking donations to assist orphans in nations struck [...]

But City Manager Ken Pulskamp, on advice from the city attorney, decided against the donation when staffers found possible ties between the foundation and Scientology during the vetting process. City spokeswoman Gail Ortiz said the First Amendment forbids government from making direct donations to religious groups, and that there will be no further discussion of the request by the City Council."

Scientology's volunteers get frosty reception at fire scene

"As fire raged inside the LaSalle Bank building, a band of serious-looking young adults in yellow jackets hustled past the police tape toward the action. Their coats bore the words 'Volunteer Minister.' But these weren't your standard chaplains -- like the five Catholic, Jewish and Protestant clerics already on the scene.

The volunteer ministers are members of the Church of Scientology, a religious group founded in 1954 by the late science fiction writer L. Ron Hubbard and perhaps best known for celebrity followers such as John Travolta and Tom Cruise. Some critics -- including the German government, which views it not as a religion but a money-making scheme -- insist Scientology is a cult.

This was the first time the group's ministers responded in an organized fashion to a fire in Chicago -- and it probably won't be their last, even though their debut didn't go over too well with the Chicago Fire Department's chaplain corps.

'I threw 'em out,' said one chaplain. 'If they want to minister to the people on the sidelines, that's great . . . but they were standing in the triage and treatment area and they were making total chaos in there.

'We can't have untrained people at a time when things are very chaotic and you need a sense of order,' he said. 'Fire and police chaplains are trained in how to do this.'

Mary Ann Ahmad, a spokeswoman for the Church of Scientology in Chicago, was told by her people that the volunteers were looking for someone in charge 'to find out what was needed and wanted, and they were told, 'It's dangerous for people in here, so go outside.' '

If Scientology volunteers need special training, 'they're totally willing,' Ahmad said, adding Scientologists were at Ground Zero after the 9/11 attacks.

David Klarich, one of the Scientologists at Monday night's blaze, said the church is planning on regularly showing up at fires and other disasters in the region to offer an 'assist' -- special techniques they use to aid the injured or traumatized.'"
